This Privacy Policy and Personal Data Notice (the “Policy”) explains how Precena Strategic Partners Malaysia (the “Company,” “we,” “us,” or “our”), acting as a Data User, collects, uses, processes, discloses, transfers, and protects personal data when you access or use our websites, online platforms, and e-learning services (collectively, the “Services”).
By using the Website or Services, or by communicating with us, you acknowledge that you have read this Policy and explicitly consent to the processing of your Personal Data in accordance with this Policy.
1. Applicable Laws and Regional Disclosures
1.1 Malaysia PDPA We handle Personal Data in strict compliance with the Personal Data Protection Act 2010 of Malaysia (“PDPA”) and maintain reasonable security arrangements to protect your data.
1.2 International Users We provide Services globally. If you access the Services from outside Malaysia, your personal data may be collected, used, and transferred internationally. Depending on your location, additional data protection laws may apply, including the EU GDPR, UK GDPR, and applicable U.S. state privacy laws.

3.1 Information You Provide: Name, email address, phone number, National Registration Identity Card (NRIC), Passport, organization/company details, job title, billing information, login credentials, and learning-related submissions (e.g., course progress, assessments).
3.2 Payment Information: Handled by third-party payment service providers. We only receive limited information necessary for confirmation, invoicing, and fraud prevention.
3.3 Automatically Collected Information: IP address, browser type, device information, usage activity, session duration, and Cookies.
3.4 Information from Third Parties: Employer or organization administrators, payment providers, and analytics providers.
2.1 “Personal Data” means any information in respect of commercial transactions, which relates directly or indirectly to a Data Subject, who is identified or identifiable from that information, as defined under the PDPA.
2.2 “Sensitive Personal Data” includes any personal data consisting of information as to the physical or mental health or condition of a Data Subject, political opinions, religious beliefs, or the commission of any offence.
2.3 “Data Subject” means an individual whose Personal Data is processed.
2.4 “Data Processor” means any person or entity (other than an employee of the Data User) who processes Personal Data solely on behalf of the Data User/Data Controller.
2.5 “Data User” / “Data Controller” means a person or entity who either alone or jointly or in common with other persons processes any Personal Data or has control over or authorizes the processing of any Personal Data. (Note: Under the PDPA, the official legal term used is “Data User”, which performs the functions of a “Data Controller” under international laws such as the GDPR).

8. Cross-Border Transfers (Section 129 of the PDPA)
Because we operate globally, you hereby expressly consent to the transfer of your Personal Data to places outside of Malaysia where our service providers, cloud servers, or affiliates are located. We take reasonable steps to ensure such transfers offer comparable protection to the PDPA.

We retain Personal Data only as long as necessary to fulfill the purposes described in this Policy, or to comply with legal, tax, and accounting requirements.

We implement reasonable administrative, technical, and physical security measures designed to protect Personal Data against loss, misuse, modification, unauthorized or accidental access, or disclosure.

12. Sensitive Personal Data
We do not intentionally collect Sensitive Personal Data unless required for legitimate purposes and explicitly provided by you with explicit consent as mandated by the PDPA.
